It is your responsibility to provide accurate, current, and complete information on the registration forms, including an email address that is different from the domain you are signing up under. If there is any abuse issue or we need to contact you, we will use the primary email address we have on file. It is your responsibility to ensure that the contact information for your account including any domain accounts is always accurate, correct, and complete. ALAAN is not responsible for any lapse in the Services, including – but without limitation, any lapsed domain registrations due to outdated contact information relating to the domain. If you need to verify or change your contact information, you may update it in your client area or contact ALAAN Support Center to update your contact information. Bearing in mind that, providing false contact information of any kind may result in termination of your account. In ALAAN PaaS Services, hosting services or certain other cases, you may be required to provide government issued identification and possibly an ID scan to use for verification purposes. Failure of providing the requested information, may cause denial of your order.

You agree to be fully responsible for any use of your account and for any actions taken through using your account. It is your responsibility to maintain the confidentiality of your password and any other information related to the security of your account.

The Service and any data you provide to ALAAN is hosted inside the country, where you host in case you hosted in Tripoli Data center your data will be always inside Libya. If you access the Service from outside of Libya, you are voluntarily transferring information (potentially including personally identifiable information) and content to Libya, and you agreeing that our collection, use, storage and sharing of your information and content is subject to the laws of Libya. With regardless of the authority applicable in the place you are located.

Migration
Our Support Team will make every effort to help you in moving your website, Application, Database or VPS to us. We do not make any guarantees regarding the availability, possibility, or time required to complete an environment transference. Each provider is configured differently, and some providers save data in an incompatible or proprietary format, which may make it extremely difficult, if not impossible, to migrate some or all data. In some cases, we may not be able to assist you in transferring data from an old provider.

Account Owner Permissions
An Account Owner shall have the authority to perform the following functions in respect of an Account created by them:

Open, modify, suspend, and terminate accounts for users.

Restrict access to the Forums for any or all users.

Change passwords for Users.

Free Trial Period
A free trial period enables you to test the ALAAN services and features before taking any decisions with limited resources.

Refunds
We do not make refunds or issue credits relating to partial calendar months of Service not consumed at the point of termination or suspension of an account. Service is provided on a calendar month basis and billed once per calendar month in advance (unless separate terms have been agreed by us in writing) for that entire calendar month.

Billing and Payment Information

Prepayment It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. You must agree to pay for the services in advance before the services are provided. The payments received will be first applied to the oldest outstanding invoice in your billing account and it is Subject to applicable laws, rules, and regulations.

Post Paid You will be billed by end of every calendar month for your total consumption of the ALAAN PaaS services and all balance must be paid within seven (7) days of the invoice issued date.

Suspension Of Account For Non Payment
Your Account will be locked at our discretion if fees are due in respect of the mentioned period in invoice for which Service has been enjoyed, however caused. If your Account is placed in suspension, it will remain functional, but your application will be suspended and stop being available, and you will be denied access until we have received payment of Fees due. Suspended Accounts will be deleted from our systems after 30 days have elapsed from suspension of an Account.

Fraud
It is a violation of this Agreement for you to misuse or fraudulently use credit cards, charge cards, electronic funds transference, electronic checks, or any other payment method. ALAAN may report any such misuse or fraudulent use, as determined in ALAAN sole discretion, to governmental and law enforcement authorities, credit reporting services, financial institutions and/or credit card companies.

Invoice Disputes
You have fourteen (14) days to dispute any charge or payment processed by ALAAN. If you have any questions concerning a charge on your account, please reach out to our billing department for assistance.

Payment Card Industry Security Standard Disclaimer
ALAAN has an undergoing project to comply with the Payment Card Industry Security Standard (PCI DSS) regarding the collection and processing of our customer’s data and billing information. However, you are solely responsible for the security of the data and billing information on your User Website. ALAAN does not monitor User Websites for PCI compliance and we are not able to verify whether a User Website complies with the PCI Standard.

Termination Of The Service By You
Subscriber may cancel his/her Account at any time. You are responsible for properly cancelling your Account by notifying us via links contained with the account management section of the Website. We shall not act upon telephone or requests to close by facsimile or email. We reserve the right to not cancel any Account until we are satisfied that the request is genuine and issued by an authorized source. Upon cancellation, your Account shall be immediately deleted from our systems, and you shall not be charged again. Please be aware that we may for a time retain residual information in backup and/or archive files of our database. Please note any requested account have unpaid amount must be clear before cancel the service and you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation.

Termination Of The Service By Us
We may at our sole discretion cancel the Service and terminate any agreement and suspend use and access to any Account or User account at any time, without notice. However, we shall issue notice to you of suspension, although successful delivery of such a notice (which shall be in writing and in electronic form), shall have no bearing as to the validity of suspension. Examples (not restricted) of circumstances which will result in cancellation of an Account are:

You fail to pay amounts due to us on the due date for payment.

We have reason to believe that the payment mechanism used by you is being operated in a fraudulent manner or may be used for fraudulent intention.

Incorrect or inaccurate contact and personal information has been provided by you.

You fail to comply with all provisions of these Terms of Use as updated and amended.

You fail to cooperate with any investigation undertaken by us or by any third party with whom we are obliged to co-operate.

We consider your use of the Service to be unacceptable.

We consider that you are not using the Service in a manner which is consistent with any applicable local, state and federal laws.

We consider that you are using the Trial mode for the commercial purposes including the cryptocurrency mining.

Re-Activation Of Accounts
Once cancelled or terminated, under no circumstances are Accounts re-activated. A new Account may be opened, subject to satisfactory completion of authorization routines set in place and adopted by us.

Uptime Guarantee
Uptime guarantee for all ALAAN Services is 99%, this uptime guarantee does not apply to planned maintenance. In case has a physical downtime that falls short of the 99% uptime guarantee, you may receive one (1) month of credit on your account, the approval of any credit is at the sole discretion of ALAAN, it may be dependent upon the justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system which may differ from the uptime reported by other individual services. To request credit, please send an email to support@alaan.ly to create a support ticket to our Billing department with justification [within thirty (30) days of the month for which credit is requested].

Data Protection
As all our data center Services are used for productive workload, data backups are replicated across to the location (every 24 Hrs.), This assures that all customer data is safe with us, even in case of an unforeseen disaster.

Data Retention
By default, our backup data retention policy is set to 3 days. Customers who need longer retention periods have the option to create their own, more granular backups at the OS/Application level.

Force Majeure
We shall not be liable to you or any third party, firm or entity for any failure of performance under applicable Terms of Use, if such failure is due to any cause or causes including, but not limited to strikes, riots, vandalism, fires, inclement weather, third-party provider outages, cable cuts, power crisis shortages, national emergencies, lockouts, work stoppages, shortages, breaches or delays, acts of terrorism, and floods, or other similar occurrences; any law, order, regulation, direction, action or request of any government (including state and local governmental agency, department, commission, court, bureau, corporation or other instrumentality of any one or more of said governments).

ALAAN Service Level Agreement
ALAAN Cloudegde is the common name for ALAAN’s ecosystem of physical and logical components upon which we deliver our core, connectivity, cloud services and products.
We guarantee response times for all customer tickets which are reported via our support portal or via e-mail. We monitor all our infrastructure and core services 24x7 and we provide customer support according to this support SLA. 24x7 monitoring of customer environments is not included in the base service but is available as an add on.
All our customers should use support email, support@alaan.ly to report any issue that may variably disturb their services availability and continuity.
All incidents reported to ALAAN support team are assigned severity based on the impact on your business. Severity may be changed after initial contact and assessment of the issue made by an ALAAN support engineer. The following information defines the severity and the targeted initial response times. Please keep in mind to clearly explain the business impact of your issue when contacting ALAAN support team.
Urgent - Business Critical Impact
30-minute maximum response time.
A customer’s production service is stopped, and its commercial end users cannot reasonably continue to work. The customer cannot resolve the issue on his or her own.
For Urgent severity issues, ALAAN will begin work on the issue within 30 minutes of notification and will continue to process with top priority until the customer is given a fix or workaround, or the severity of the issue is being downgraded. Customer resources must be made available, and the customer should reasonably cooperate with ALAAN to resolve issues.
Urgent severity issues may have:

Data loss or data corruption.

Critical functionality not available.
High - Significant Business Impact
1-hour maximum response time.
Important product features are unavailable with no acceptable workaround. Customer or customers end users’ production services are functioning with limited capabilities or are unstable with periodic interruptions. Software may be operating but is severely restricted.
